Acceptance of our terms

These are the Terms and Conditions which apply in respect of precious Metal buying services offered via TheGoldSpot.co.uk. Please read this agreement carefully. This agreement should be read in conjunction with our Privacy Policy. If you do not agree to these, you may not use TheGoldSpot.co.uk.

You are permitted to use TheGoldSpot.co.uk solely on the basis of these Terms and Conditions. We reserve the right, at our discretion, to update and/or revise these Terms and Conditions. Please check periodically for changes.

Restrictions on using the Services 

​

In using the Services, you warrant that:

 

  • You are at least 18 years of age;

  • You are legally able to enter into a binding contract;

  • You are resident in the UK;

  • You have good title to the precious Metals which you intend to sell;

  • Such Metal will be sold free from any liability or adverse claim of any type whatsoever and;

  • You are using the Services privately and in your personal capacity only and not using them for commercial or business purposes (whether directly or indirectly);

  • All information which you submit to us is true and accurate;

  • If the Metal which you intend to sell to us is worth the aggregate amount of £1,000 or more, you agree that you will provide us with proof of identification as we may require this in order to satisfy our legal obligations;

  • We reserve the right to request Proof of Purchase of items when selling to TheGoldSpot.co.uk; 

  • You will not submit any material that may be deemed hazardous or that do not contain precious metal;

  •  Any goods you send that do not contain precious metals will be returned at your own cost and understand that TheGoldSpot.co.uk is not liable for any losses or damages that may occur;

  • You understand that payment within 24 hours is not guaranteed;

  • By posting your Metal to TheGoldSpot.co.uk, you agree to the Terms and Conditions and are making an irrevocable offer to sell your Metal to us, regardless of whether your Customer Declaration has been signed.

Postage

​

TheGoldSpot.co.uk will ONLY accept Royal Mail Special Delivery pre-paid postage bags when sending your Metal to us. 

​

Our pre-paid bag service is only for customers who have offered to sell us Metal by successfully completing our Postal Form and have accepted our Terms and Conditions and Privacy Policy. 

 

Metal sent using our pre-paid bag service is insured by Royal Mail for up to £750.00 only whilst in transit. If you believe your Metal is worth more than £750.00, YOU will need to pay for additional insurance at your Post Office. 

 

We reserve the right to reject the receipt of any pack which looks as if it has been tampered with or damaged in transit.

 

In the event that your items are found to be without significant value, you will be charged £15.00 for their return.

Sending us your Metal - Royal Mail Special Delivery Pre-Paid Bags 

​

Securely pack your Metal using the pre-paid postage bag provided, including your Postal Form, and send them to us from any Post Office. 

​

It is your responsibility when posting your Metal to:

​

  • Ensure the Metal is securely packaged and sealed;

  • Enclose your Postal Form;

  • Ensure the pack is correctly addressed;

  • Ensure the pack includes the sender’s name and address;

  • Increase the insurance cover and pay any additional charges if you believe your items to be worth more than £750.00.

 

All Metal sent to us is done so at the owner’s risk until received and signed for by TheGoldSpot.co.uk.

The Postal Form

You must complete and enclose the Postal Form when sending us your Metal. On the Postal Form, you are required to provide us with the details of the individual items you are sending to us and must sign and date the Declaration of Ownership.

​

TheGoldSpot.co.uk reserves the right to decline any Metal sent to us if the Postal Form is incomplete and/or unsigned.

 

 

Processing Your Metal 

​

On the first working day (excluding Bank Holidays) that we receive your Metal, our expert valuers will complete an assessment of its characteristics. 

 

In order to accurately assess the characteristics of your Metal, you agree to allow our expert valuers to carry out both destructive and non-destructive testing. This may include (but shall not be limited to) filing, acid testing and dismantling, and removal of stones, workings and other non-precious Metal items. 

​

This process may result in Metal being permanently scratched, disfigured, stained or broken.  

We shall not be responsible for returning Metal to the condition it was in when we first received it, nor shall we be responsible for any losses which you may incur as a result of any testing procedures.

​

We reserve the right to refurbish, alter, resell or dispose of all items purchased at our discretion.

 

​

Valuations & Offers

​

Once the assessment of the Metal’s characteristics is complete, TheGoldSpot.co.uk will provide you with an offer via email, SMS or phone to purchase your Metal.

​

You can then either accept our Offer or reject our Offer and we will return your Metal free of charge by Royal Mail Special Delivery. 

​

Due to constant changes in price, our offer is valid for 24hrs only. 

​

Acceptance of our offer is irrecoverable as the Metal will be immediately sent for refining.

​

​

Gemstones 

​

TheGoldSpot.co.uk accepts gemstones within settings, however, it is important to note that they generally do not have significant value.  The value of any gemstones will be valued and taken into account when an offer is made to you.

 

 

Title & Risk

​

You will always remain the owner of your Metal until you accept our Offer. If we return your Metal to you, you will remain the owner of the Metal at all times.

​

We are only responsible for loss or damage to your Metal caused by our negligence or breach of contract from the time that we accept delivery of the Metal. 

​

In such circumstances, we are responsible for losses which you suffer only to the extent that they are a foreseeable consequence, limited to a maximum aggregate liability of the valuation provided by our expert valuers at the date of the occurrence.

​

Our services are for domestic and private use only.

​

We accept no liability for any loss of profit, business or business interruptions.

​

You and any relevant third parties are bound by the limitation outlined. Should your insurance carrier issue a subrogation claim in any circumstance where you, the individual, could have brought such a claim against us, we accept no liability and you waive your right to any such claim, through your insurance carrier’s behalf or individually.

​

We shall have no liability or responsibility for any delay or failure to perform any of our obligations under these Terms and Conditions caused as a result of acts or events which are beyond our reasonable control (‘Force Majeure Events’).

​

If we return your Metal to you, we will no longer be responsible for any loss or damage to your Metal from the point at which the Royal Mail (or other relevant carriers) takes physical possession of your return pack.  Any claims would need to be made with Royal Mail.

 

 

Lost or Stolen Items

​

It is your responsibility to obtain proof of sending and retain the tracking information for insurance purposes when sending your Metal with our pre-paid Royal Mail service. If you do not retain this information, you may be unable to bring a claim for a lost or damaged item.

​

You must notify us of all claims in writing within 28 calendar days from the date of posting with Royal Mail so that we can adhere to the deadline of 3rd party couriers. We will not consider under any circumstances claims that are made after this date and no legal liability will be assumed.

​

In the event of a lost or damaged pack, in calculating value, only the evaluation of the scrap Metal value will be considered and not any value for gemstones, rarity or resale values. The courier service may also require you to provide comprehensive evidence and proof of the value of the goods enclosed, this includes but is not limited to photographs, written valuations, weights and purchase receipts.

We do not assume any responsibility for loss, theft or damage to packs that occur in transit to us. Any claim will be brought against Royal Mail and not TheGoldSpot.co.uk.

​

​

Payment

Once an offer has been accepted, you will need to provide us with your bank account name, number and sort code so we can make payment to you. All payments are made using BACs transfer only. 

 

​

Returned Items 

Items sent to us without significant value will carry an administration fee of £15.00 for their return to you.

 

​

Unidentifiable Packs

​

If the Postal Form has not been enclosed or is incorrectly completed, we may be unable to identify the owner. If we cannot trace and identify the owner, the items will be deemed lost property and will be securely held by us for a period of six months. To reclaim unidentified Metal, the customer will need to provide a full description of the Metal before a new offer may be made subject to a deduction for storage, insurance and administration costs.

 

If there has been no claim within six months the items will be refined to recover our storage and insurance costs. Any claim received after six months will be paid less any charges incurred to date.

Items Sent in Error (Not Intended For Us)

​

Our Special Delivery envelopes are marked with a unique code and are for our customers sending metal with the intent to sell only. 

​

If using our Special Delivery envelope to send items that are intended for someone else, the fee for returning these items is £20.00, to cover postage, insurance and administration costs.

 

​

Claims

​

A customer who wishes to submit a claim must notify us immediately. The customer must submit any and all supporting documentation requested. Failure to do so may result in the denial of the claim.

 

There is a 14-day processing period from the time we are notified of the claim and the claim being processed. 

 

Your statutory rights remain unaffected.

 

All phone calls between TheGoldSpot.co.uk and its customers or potential customers may be recorded for security and training purposes. Any such recording may be relied upon by TheGoldSpot.co.uk in the event of any dispute.

General Terms

Intellectual property

​

Nothing in these Terms and Conditions grants you a licence to use any of our trademarks or other intellectual property for any purpose whatsoever.

How we will use your personal information

​

We will use your personal information for the sole purpose of providing you with our Services and to complete payment due to you in respect of such Services. More information can be found in our Privacy Policy.

Indemnification

​

You agree to indemnify us against all liabilities, claims, losses, costs and fees which we incur as a result of any breach by you of these Terms and Conditions (including, but not limited to, claims brought by third parties).

Other important Terms and Conditions

​

We may transfer our rights and obligations under these Terms and Conditions to another organisation.  We shall notify you in writing if this happens, any such transfer will not affect your rights or our obligations under these Terms and Conditions. 

​

Each of the paragraphs of these Terms and Conditions operates separately.  If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs shall remain in full force and effect.

​

​

Jurisdiction 

​

These Terms and Conditions are governed by English and Scottish Law and the parties to them hereby submit to the exclusive jurisdiction of the courts of England and Wales in respect of any dispute or claim that arises out of or in connection with them. No failure or delay by us in exercising any right, power, privilege or remedy available to us under these Terms and Conditions or in law shall constitute a waiver of that right, power, privilege or remedy.
